At ONFORM, we act as Employer’s Agent (EA) under JCT Design & Build contracts, representing the client throughout the project lifecycle. Our role ensures that the contractor delivers against the Employer’s Requirements while protecting the employer’s contractual, financial, and quality interests.

Pre-Contract Employer’s Agent Duties
As Employer’s Agent, ONFORM supports clients by:
Preparing Employer’s Requirements (ERs) – Drafting clear, robust documentation to define the client’s expectations.
Reviewing Contractor’s Proposals (CPs) – Assessing design, quality, and cost submissions against the ERs.
Advising on Contract Execution – Recommending amendments, warranties, bonds, and insurance provisions before contract signing.
Tender Management – Running competitive tenders, evaluating bids, and recommending a suitable Design & Build contractor.
Statutory & Warranty Compliance – Coordinating planning conditions, Building Regulations, and warranty provider requirements pre-contract.
Construction Phase Employer’s Agent Duties
During the build, ONFORM administers the Design & Build contract by:
Issuing Instructions – Managing formal EA Instructions and contract communications.
Certifying Payments – Reviewing valuations, assessing progress, and issuing Interim Certificates.
Managing Variations – Controlling and documenting any changes to scope, design, or cost.
Monitoring Progress & Quality – Regular site visits and reporting to confirm compliance with ERs and CPs.
Assessing Extensions of Time – Reviewing contractor claims for time and cost, ensuring fair outcomes for the employer.
Practical Completion & Handover – Certifying completion, overseeing snagging, and managing warranties and final accounts.
